EAA INFORMATION FOR EMPLOYERS
Under the EAA regulations, Scantec Personnel is required to confirm the identity of the personnel we provide to you and we do this by obtaining documentation from our candidates. We will also ask for confirmation of mandatory training or qualifications that you request for specific positions you are looking to fill.
We are also obliged to request information from our clients with regard to potential Health and Safety risks, as well as details of any steps that are being taken to prevent and control such risks. We have devised a Health and Safety Questionnaire that can be filled out by our clients and sent to candidates prior to the commencement of employment.
With respect to "temporary to permanent"’ fees we are required to offer our clients an option of an "extended period of hire" as an alternative to paying a fee. This issue is covered thoroughly in Scantec’s Terms of Business.
OPTING OUT
Limited Company Contractors are permitted to ‘opt out’ of the scope of the Regulations unless they are involved in working or attending any person who is under the age of 18, or who by reason of age, infirmity or other circumstance, is in the need of care and attention.
Opting-out of the Conduct Regulations will have benefits for Limited Company Contractors and may bring them a step closer to being seen as genuinely self employed and therefore they could be viewed as outside the scope of IR35 tax rules.
If, however, they decide to remain within the Conduct Regulations Limited Company Contractors will be offered the same protection as that afforded to PAYE workers.
Scantec will inform its clients if a Limited Company Contractor chooses to opt-out of the Conduct Regulations.
